Today’s Daf Yomi Question:

There is a quote in the name of Rav Chaim Brisker that ‘miracle items’ are not suitable for use in the Mishkan/Beis Hamikdash since the Torah specifically requires natural occurring materials.  For example, ‘miracle- oil’ would not suitable for the Menorah since the Torah speaks of ‘Shemen Zayis’ and not ‘Shemen Neis’.  How was the Tachash used for the Mishkan if it was a result of a timely miraculous creation?

  1. The idea of saying Shemen Zayis and not Shemen Ness is that the Shemen Ness does not come from a Zayis, and therefore is in fact not Shemen of Zayis — even if it’s chemical makeup is the same. An animal that wasn’t born from another animal is still an animal.

    What would be interesting is that we cannot learn the Melachos of Shechita and Hafshata from the Tachash. Being that it wasn’t born from an animal, it should have the status of a Kina, which is Mutar to kill on Shabbos according to the Chachamim. We would learn them from the goats.

  2. שבת (כח:) והאמר אביי שי”ן של תפילין הל”מ, פירש”י שיהיה העור נקמט מבחוץ וכו’ והרצועה נקשרת כמין דלית וכו’ וקשה לפ”ז נמצא שאף בהרצועות יש כתיבת אות השם וא”כ בעינן מן המותר בפיך, ואיך אמרי’ אח”כ דאיצטריך לרצועות.

    • ברוך שכוונתם לדברי התוס’ (ברכות ו: ד”ה אלו תפילין שבראש) שמקשה קושיא זו על פירוש רש”י, ומוכיח מקושיא זו שהלכה למשה מסיני קאי רק על השי”ן ולא על דלי”ת ויו”ד. אולם מדברי התוס’ מנחות (לה: ד”ה אלו תפילין שבראש) נראה שבא ליישב דברי רש”י, דרק השי”ן נחשב אות גמור אבל דלי”ת ויו”ד אע”ג שנראין כמו אותיות אין להם דין אותיות גמורות הלכך אין הם נכללים בין מן המותר בפיך. וכן משמע מדיוק הלשון ברש”י כאן (שבת כח: ד”ה שי”ן של תפילין) שכתב וז”ל, דאות השם נכתב בקמטין שלו כו’ משמע רק שי”ן אית ליה תורת כתיבה ותורת אות ולא דלי”ת ויו”ד.

    • R’ Elazar’s query was based on:

      1) The din of ohel is learned exclusively from the Mishkan – he obviously didn’t apply Rava’s kal vachomer (from goats’ hair).

      2) R’ Elazar’s uncertainty whether Tachash was tamei or tahor – he obviously didn’t subscribe to the conclusion of the Gemara that the Tachash was tahor.

      In summary, according to the maskana, theoretically there doesn’t seem to be anything preventing use of non-kosher hide for the Mishkan – although factually the Tachash happened to be tahor. Nevertheless non-kosher hide is an ohel on account of the kal vachomer from goats’ hair. However according to R’ Elazar we can only learn from the Mishkan, and since we are uncertain as to the nature of the Tachash, we are left with the uncertainty regarding non-kosher hide for the din of ohel.
