Today’s Daf Yomi Question:

The Gemara tells us that ‘Beis Nitza’ were conscientious people and the gezeira (of dragging a heavy bench on a stone floor) did not apply to them.  Asks Rav Moshe Feinstein, we don’t seem to find that the Chachamim would differentiate between people when applying a gezeira; if so how were Beis Nitza allowed to exempt themselves from a universal gezeira?

(Although we learned earlier about exemptions for Kohanim in the Beis Hamikdash, or by the Korban Pesach, that is because the gezeira was never meant to apply to those scenarios in the first place)

  1. Lemaskana did rav be mekabel from r chiya ? the gemara doesnt seem to answer it.

    Lemaskana tell me if i am correct- reb akiva holds by a mogud and achorei hadeles like r yehoshua that its tahor in both case.

        • True. The Gemara was pointing out that Rav never explicitly stated this halacha of muktzeh by pits, rather it was R’ Yehuda’s interpretation of events, which according to our version of events remains inconclusive and unresolved. However, the fact that R’ Yehuda states this halacha (in the name of Rav) with certainty, apparently indicates that he himself had some type of conclusive evidence of Rav’s opinion.

  2. The mishna permits putting out a flame for ‘ruach raah’ ( daf 29 b).
    How do we understand ruach raah? How do we understand the serious nature of its danger that chazal permit one to be ‘ mechabe es haner’?

    • Ruach Ra’ah can be translated as follows:
      1) A mental condition related to a severe state of depression – according to the Gilyon (on the side of the Gemara) it is ‘Mara Shechorah’ which is loosely described as above.
      2) Rashi in Eruvin (41b) describes it as one who was affected by a sheid (demon) which entered his body and causes him to be deranged.

      Our Gemara explains that this situation involves pikuach nefesh, hence the allowance to extinguish the lamp. Perhaps THIS can be explained according to both of the abovementioned translations:
      1) Darkness soothes his severe mental anguish, which could otherwise lead to his death.
      2) The presence of the sheid causes him to lose control over his functions (as described in Gemara Eruvin) which may result in infliction of self-harm etc. – something which apparently is mitigated by darkness.
