Tosfos learns that according to Rebbi Meir although he checked the house once, he needs to recheck the house.  How many times?

  1. As long as you find the Chametz the house remains Bechezkas Eina Beduka, which requires, Mide’oraysa, that you be Mevatel the Chametz. (Usually Bittul after Bedika id Miderabanan.) Once you were Mevatel the Chametz you may reside there and the Rebbe Meir agrees that for a Derabanan we may assume that the Chametz is not there.

    Tosafos and Rashi are in full agreement Lehalacha. The difference is in the P’shat of the Gemara. In fact, Rashi learns throughout the whole Sugya that we are dealing with Derabanan, and that we aren’t necessarily saying that the Machlokes is the same. We are merely bringing the MAchlokes to learn from it, and we adapt the Shittos gleaned from them to our situation. Tosafos learns that we mean to literally equate the Sugyos and that therefore part of the Sugya is discussing De’oraysa and part is discussing Derabanan. This caused Tosafos to have the Kasha by Safek Bi’ah, where Rashi easily brushed it off, saying that in our case all agree to be Meikil. We mentioned the Machlokes to learn about the special status of Safek Bi’ah.

  3. In the case of the missing axe, why don’t we say sfaik sfaika?
    It is a safaik if he lent the axe to someone or if someone entered the house and took it.
    Even if someone entered the house and took it, it is a safaik, maybe he was tomeh and maybe he was tahor.
    Therefore the other items in the house should be tahor.

    • Hi Sholom,

      Tosfos dwells on your point. Tosfos explains that there was a gezeira miderabanan that any keli that was ‘found’ lying around (i.e. exposed) is presumed to be tamei (due to a concern that it was handled by a tamei). This done was to ensure the purity of kelim. Our Gemara is based on that gezeira. If the axe was exposed to intruders, it has the status of a lost keli and presumed to be handled by a tamei.
